By creating an account or using MailQV, you agree to these Terms.
If you do not agree to these Terms, you must not use the Service.
1. The Service
MailQV provides tools for creating, managing, and sending email outreach campaigns.
Features may include:
- Email account integrations
- Contact management
- Campaign creation
- Email scheduling
- Email sending
- Campaign analytics
- Reply and delivery tracking
- Automation features
We may add, change, suspend, or remove features from time to time.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use MailQV.
If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
3. Your Account
You are responsible for:
- Providing accurate account information
- Keeping your login credentials secure
- All activity performed through your account
- Maintaining the security of connected third-party accounts
You must notify us promptly if you believe your account has been compromised.
4. Acceptable Use
You may use MailQV only for lawful purposes.
You must not use the Service to:
- Send unlawful spam
- Send deceptive or fraudulent messages
- Impersonate another person or organization
- Distribute malware or malicious software
- Conduct phishing or credential theft
- Harass, threaten, or abuse recipients
- Send content that violates applicable law
- Circumvent email provider restrictions
- Manipulate or falsify sender information
- Attempt unauthorized access to systems or accounts
- Interfere with the security or operation of MailQV
- Use contact information obtained unlawfully
- Send messages to recipients where contacting them is prohibited by law
We may suspend or terminate accounts that violate these requirements.
5. Anti-Spam and Email Compliance
You are solely responsible for ensuring that your email campaigns comply with all applicable laws and regulations.
Depending on your location and the location of your recipients, these may include:
- CAN-SPAM Act
- GDPR
- UK GDPR
- Privacy and Electronic Communications Regulations (PECR)
- ePrivacy rules
- Local marketing and electronic communications laws
You are responsible for determining whether you have the right and lawful basis to contact each recipient.
Where legally required, your emails must include:
- Accurate sender information
- A valid business identity
- A lawful reason for contacting the recipient
- A functional method to unsubscribe or opt out
You must honor applicable opt-out and unsubscribe requests.
MailQV does not provide legal advice and does not determine whether a particular campaign is lawful.
6. Contact Data
You retain ownership of contact lists, campaign data, and content you upload to MailQV.
You represent and warrant that:
- You have the right to use the data you upload
- You obtained the data lawfully
- Your processing of the data complies with applicable law
- You will respect applicable privacy and marketing rights
You grant MailQV a limited right to process this data solely as necessary to provide and operate the Service.
7. Third-Party Integrations
MailQV may integrate with third-party platforms, including email providers, authentication providers, and other software services.
Your use of third-party services is also governed by their respective terms and policies.
MailQV is not responsible for:
- Third-party service availability
- Third-party account restrictions
- Email provider sending limits
- Changes to third-party APIs
- Suspension or termination of third-party accounts
- Delivery decisions made by email providers
8. Email Deliverability
MailQV does not guarantee:
- Email delivery
- Inbox placement
- Open rates
- Reply rates
- Campaign performance
- Sender reputation
- Avoidance of spam filters
Email delivery depends on many factors outside our control, including sender reputation, email provider policies, recipient servers, message content, DNS configuration, and sending behavior.
9. Plans, Billing, and Payments
Certain features may require a paid subscription.
Prices, usage limits, and included features will be displayed before purchase.
By purchasing a paid subscription, you authorize us or our payment processor to charge the applicable fees.
Unless otherwise stated:
- Subscription fees are billed in advance
- Subscriptions automatically renew until cancelled
- You may cancel future renewals through your account
- Fees already paid are generally non-refundable except where required by law
We may change pricing or plan features, but changes will not apply retroactively to an already-paid billing period unless required for legal or security reasons.
10. Free Trials
MailQV may offer free trials or promotional access.
We may modify or terminate trials at any time.
If payment information is required for a trial, the applicable subscription fee may be charged automatically when the trial ends unless you cancel beforehand.
11. Fair Use and Service Limits
We may impose reasonable limits relating to:
- Sending volume
- API usage
- Contact storage
- Automation activity
- Connected accounts
- Requests per minute
- Infrastructure usage
We may restrict activity that creates excessive load, damages service reliability, or poses security, compliance, or deliverability risks.
12. Suspension and Termination
We may suspend or terminate access to the Service if we reasonably believe that:
- You violated these Terms
- Your activity creates a legal or security risk
- Your activity causes significant deliverability or abuse issues
- Your account is associated with fraud or unlawful behavior
- Continued access could harm MailQV, our users, third-party providers, or recipients
You may stop using MailQV at any time.
Termination does not eliminate payment obligations or liabilities that arose before termination.
13. Intellectual Property
MailQV and its licensors own all rights in the Service, including its:
- Software
- Interface
- Branding
- Design
- Documentation
- Logos
- Technology
These Terms do not transfer ownership of MailQV intellectual property to you.
You may not copy, reverse engineer, resell, or commercially exploit the Service except where explicitly permitted by us or applicable law.
14. Feedback
If you provide ideas, suggestions, or feedback about MailQV, you grant us permission to use that feedback without restriction or compensation.
15. Service Availability
We aim to provide a reliable Service, but we do not guarantee uninterrupted or error-free availability.
The Service may occasionally be unavailable due to:

- Infrastructure failures
- Third-party outages
- Security incidents
- Software errors
- Events outside our reasonable control
16. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis.
We disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will produce specific business, marketing, or financial results.
17. Limitation of Liability
To the maximum extent permitted by applicable law, MailQV will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of:

- Profits
- Customers
- Data
- Business opportunities
- Reputation
To the maximum extent permitted by law, MailQV's total liability arising out of or relating to the Service will not exceed the amount you paid to MailQV during the 12 months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded.
18. Indemnification
To the extent permitted by law, you agree to indemnify and hold MailQV harmless from claims, losses, liabilities, and expenses arising from:
- Your use of the Service
- Your campaigns
- Your contact data
- Your violation of these Terms
- Your violation of applicable law
- Your infringement of third-party rights

By using the Service, you acknowledge that you have reviewed our Privacy Policy.
20. Changes to These Terms
We may update these Terms from time to time.
If changes are material, we may provide reasonable notice through the Service or by other appropriate means.
Continued use of MailQV after updated Terms become effective constitutes acceptance of the revised Terms.
21. Governing Law
These Terms will be governed by the laws applicable to the legal entity operating MailQV, without regard to conflict-of-law principles.
If MailQV is operated by a company incorporated in England and Wales, these Terms will be governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, except where mandatory consumer protection laws require otherwise.
